Form 37a – Self-Resolution with Owner / Occupier

What it does:
Form 37a is used when there is a dispute between owners and/or occupiers that you want to try to resolve directly. It encourages documented attempts at resolution and supports issuing breach notices if required.

When to use it:

• Neighbour disputes (e.g. noise, shared facilities).
• Behaviour or by-law concerns affecting another resident.
• Any issue where direct communication and resolution is possible.

Why it matters:
Rather than relying on informal messages, this form gives a structured way to record the issue, proposed resolution and parties’ attempts to settle it. This can be evidence of self-resolution if any further dispute application becomes necessary.

Form 37b – Self-Resolution with the Body Corporate

What it does:
Form 37b is for situations where an owner or occupier believes that the body corporate or committee has taken an action or made a decision that may breach legislation or the community titles scheme (CTS) and seeks a remedy through a documented self-resolution step.

When to use it:

• The committee decision is believed to conflict with the BCCM Act.
• A body corporate action seems contrary to your rights as an owner.
• You want to formally raise concerns about how a decision was made.

Why it matters:
This form provides a formal route to raise issues about committee decisions before escalating to formal dispute resolution (e.g. conciliation or adjudication). It encourages communication and gives the body corporate an opportunity to address concerns early.
